Welcome to Creative Assist AI. By using our website, platform, or services, you agree to be bound by the following Terms and Conditions. Please review them carefully. If you do not agree, do not use our services.
1. Use of Services
You may use the Services only for lawful purposes and in accordance with these Terms.
You agree not to:
• submit or generate content that is illegal, harmful, abusive, or infringes the rights of third parties
• violate intellectual property, privacy, or other legal rights
• attempt to hack, scan, disrupt, reverse engineer, or gain unauthorised access to the platform or its infrastructure
• misuse referral, promotional, or free-trial systems
• use the Services to distribute malware, spam, or harmful instructions
We reserve the right to suspend or terminate accounts that violate these Terms or misuse the Services.
2. Account Registration
Certain features of the Services may require registration.
By creating an account, you agree to:
• provide accurate, complete, and up-to-date information
• keep your login credentials secure
• notify us immediately of any unauthorised use of your account
You are responsible for all activities that occur under your account.
We may suspend, restrict, or delete accounts that are fraudulent, abusive, or violate these Terms.
3. Intellectual Property
All platform software, algorithms, designs, tools, text, graphics, logos, and other materials are owned by or licensed to Creative Assist AI and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal or internal business purposes.
You may not:
• copy or reproduce the platform
• distribute or resell the Services
• create derivative works from the platform
• use the Services to develop competing systems
without our prior written consent.
4. User Content
The Services may allow you to submit prompts, inputs, or other materials (“User Content”).
You represent and warrant that your User Content:
• complies with applicable laws
• does not infringe third-party rights
• does not contain unlawful or harmful material
You grant Creative Assist AI a non-exclusive, worldwide, royalty-free licence to host, process, store, and display User Content solely for the purpose of operating, maintaining, and improving the Services.
We are not responsible for User Content created by users.
5. AI-Generated Content
The Services generate outputs using artificial intelligence technologies.
AI-generated outputs:
• may contain inaccuracies or incomplete information
• may resemble existing content
• should be reviewed and verified before use
Creative Assist AI does not guarantee the accuracy, originality, or suitability of generated outputs.
Users are responsible for how generated content is used.
6. Free Trial Usage
New users may receive limited free access to the Service, including for example up to 500 tokens of generated content, in order to test the platform.
Free trial tokens:
• have no monetary value
• cannot be transferred, sold, or exchanged for cash
• may be limited to specific features or usage
• may be changed, restricted, or discontinued at any time
Creative Assist AI reserves the right to restrict or terminate accounts that attempt to abuse free trial tokens, including creating multiple accounts to obtain additional free access.
Free trial tokens represent service usage units only and do not constitute stored value, electronic money, or financial credit.
7. Fees and Payment
Some features of the Services may require payment.
Prices are listed in EUR unless otherwise stated and are payable in advance.
Applicable taxes may be applied depending on your location.
Payments are processed by trusted third-party payment providers. We do not store full payment card details on our servers.
Failure to complete payment may result in restricted access or suspension of the Services.
8. Refunds
Purchases are generally non-refundable, except where required by applicable law.
Refunds may be considered if:
• the service was not delivered
• a verified technical error prevented access
• a duplicate payment occurred
Refund requests must be submitted within 14 days of purchase.
Approved refunds will be returned to the original payment method within a reasonable timeframe.
For digital services delivered immediately at your request, the statutory EU 14-day withdrawal right may not apply once the service has begun, where permitted by law.
Nothing in these Terms limits your statutory consumer rights.
9. Third-Party Services
The Services may include links to or integrations with third-party services.
We do not control these third-party platforms and are not responsible for their content, policies, or availability.
Your use of third-party services is at your own risk and subject to their respective terms.
10. Suspension and Termination
We may suspend, restrict, or terminate your account or access to the Services if:
• you violate these Terms
• your activity creates legal or security risks
• you misuse the platform
You may stop using the Services at any time.
11. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
To the maximum extent permitted by law, Creative Assist AI disclaims all warranties, including:
• merchantability
• fitness for a particular purpose
• non-infringement
• uninterrupted or error-free operation
12. Limitation of Liability
To the maximum extent permitted by law, Creative Assist AI shall not be liable for:
• indirect or consequential damages
• loss of profits
• loss of data
• loss of goodwill
Our total aggregate liability for any claim arising from the Services shall not exceed the total amount paid by you for the Services during the 12 months preceding the claim.
Nothing in these Terms excludes liability where such limitation is prohibited by law.
13. Governing Law and Disputes
These Terms are governed by the laws of the Czech Republic.
Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of the Czech Republic, unless mandatory consumer protection laws provide otherwise.
If you are an EU consumer, you may also use the EU Online Dispute Resolution (ODR) platform.
14. Changes to These Terms
We may update these Terms from time to time to reflect operational, legal, or technical changes.
Updated Terms will be posted on the website together with the revised “Last updated” date.
Continued use of the Services after the update constitutes acceptance of the revised Terms.
15. Age Requirement
The Services are intended for adults.
By using the platform, you confirm that you are at least 18 years old or have the required legal capacity under applicable law.
If you do not meet this requirement, you must not use the Services.
